maintenance - Young Pregnant & Parenting

Maintenance

Maintenance is money that is paid by one parent to the other parent to support the child when the parents are separated. To claim maintenance from the father of a child born outside of marriage (ex-nuptial) it must be proven who the father is. The Family Law Act recognises fatherhood if:

  • the parents are married
  • the father's name is on the birth certificate
  • the father formally admits that he is the father or
  • it is proven in court.
